Ms C, Sunbury on Thames
She had separated from her partner and was worried about him gaining residence and maintenance payments.

What did we advise?
We advised her of the payments that the CSA would request (15% of net earning) and that even if she agreed to accept less now, she would be entitled to the full 15% in the future.

We also clarified who was the child’s primary carer and as that was our client, we advised that he would be unlikely to be successful in any application for residence and that he would need to prove that she is not a capable mother.

Mrs C told us “ thank you, I’ll be able to sleep tonight for the first time in ages, do you have a solicitors firm if I need further assistance?”

 

Ms G, West Sussex
Ms G was divorced from her husband and wanted advice regarding their children. Her ex-husband was now living abroad but would not give any details to his ex-wife about where he was living or where the children would stay when visiting him.

What did we advise?
We advised Ms G that she should not allow him to see the children away from her until she had confirmation of where he was living.
