Ms A called to ask our advice regarding a Will her aunt had made. She explained that her aunt had remarried about six years ago. She suffers with dementia and was concerned that she didn’t understand what she was signing.

What did we advise?
We explained the criteria for making a valid Will and in particular the issues surrounding testamentary capacity. In other words, her soundness of mind, memory and understanding. We also advised that marriage revokes a Will so if she had an earlier Will it would be invalid.
